2 • Scope and modification of the sales conditions

The present sales conditions aim to define the contractual relationships between CESARE NORI and the buyer and the conditions applicable to any purchase made through the merchant site of CESARE NORI.

The acquisition of a product through this site implies an unreserved acceptance by the buyer of these sales conditions. These conditions of sale will prevail over all other general or special conditions not expressly agreed by CESARE NORI.

CESARE NORI reserves the right to modify its sales conditions at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer. The current general terms and conditions of sale apply exclusively to individual customers wishing to make a purchase on the www.cesarenori.fr website.

3 • The Offer

The products offered on our site are only offered for sale to non-trading individuals. The offered products are those that appear in the catalog published on the CESARE NORI site. These products and services are offered within the limits of available stocks.

Any sold-out product will be reported. However, the availability and delivery of a product are only guaranteed by the sending by us of a confirmation email of your order. The catalog photographs are as faithful as possible but they cannot always ensure a perfect similarity with the offered product, particularly in terms of colors.

Indeed, depending on the internet browser or screen used, the colors of the articles may not perfectly match the real colors.

4 • Order Validation

The buyer, who wishes to buy a product must necessarily:

Fill out the identification form on which he will indicate all the requested coordinates or connect to his customer account if he has one. Fill out the online order form by giving all the references of the selected products or services. Validate his order after having checked it. Make the payment under the conditions provided. Confirm his order and payment. 5 • Loyalty Program

Membership in the Cesare Nori loyalty program is free in-store and on our cesarenori.fr website. In-store, account opening is effective provided that the customer communicates the following information to our team: first name, last name and email address. Cesare Nori SARL reserves the right to modify the conditions of the loyalty program and the opening of the loyalty account at any time. The loyalty program allows you to accumulate 5% of the order amount (excluding shipping costs). The use of loyalty points is subject to a period of 14 days from receipt of the order. Once this period has passed, the customer simply needs to log in to their customer account and convert their available points into a discount voucher. The use of the discount voucher is eligible for each order with a minimum purchase amount of €150 excluding shipping costs for a period of one year. 6 • Price

All offers of products, services and delivery methods, at the prices indicated in Euros, are valid in mainland France, Corsica and Monaco, while stocks last. For orders from the European Union, the VAT rate applied is the same as that of France. You will simply have to pay additional shipping costs, which will be indicated to you when choosing the delivery method.

For orders outside the European Union or DOM-TOM, the products will be invoiced to you tax-free and you will have to pay shipping costs calculated according to the destination country and the weight of the package. Upon receipt of the package, you will have to pay customs duty and local VAT according to the destination country.

7 • Payment

7.1. Payment Methods

By credit card

We accept VISA, MASTERCARD, AMERICAN EXPRESS, BLUE CARD. Payments by credit card will be made through the secure system PayZen, the most secure payment system in the world that uses the TLS protocol (encryption of all information related to the card) and is subject to numerous approvals (PCI DSS certification, CB Cartes Bancaires approval, Visa merchant agent approval...). At no time do your bank details appear in plain text or are visible to the merchant. We practice the debit of your bank card at the time of order. At the buyer's request, an invoice will be sent to him on paper showing the VAT.

By credit card via Paypal:

Application of Paypal's general terms and conditions of use. In case of refund, Paypal transaction fees will be deducted.

By PayPal

To benefit from this payment method, you must have an account with the company PayPal. In case of payment by PayPal, it is the general terms and conditions of use of Paypal that apply. In case of refund or cancellation, Paypal transaction fees will be deducted. Paypal offers 4x payment for orders from 50€ to 2000€. Credit over a period of 3 months with fees of 2.1% of the amount of your transaction capped at 20€. You have a withdrawal period of 14 days to renounce your credit.

By bank transfer

When validating the order, you will receive our bank details (displayed on the online order form + e-mail), you will then have a period of 7 days to send us your transfer. Payment in installments with Alma

Cesare Nori offers you the possibility to stagger the payment of your order in 3 or 4 installments debited from your account associated with your bank card. This payment facility is offered to you free of charge and does not involve any additional fees.

However, it is possible that an identity check may be carried out by Alma to confirm your identity. An additional working day for data verification is required. If you pay for your order in installments, you accept Alma's general client conditions.

In particular, you can only pay in installments for purchases whose amount is between €100.00 and €2,500.00. The fees applicable to this means of payment are, for each transaction, 0.00%.

This option applies to orders placed in France and Belgium and is not valid for orders placed for delivery abroad.


This offer is reserved for adult individuals holding a bank card valid at least 3 months after the date of conclusion of the staggered payment contract and whose uses are not subject to a systematic authorization request (including Visa Electron, Maestro and Cirrus cards...).

Subscription terms

Payment by deposit

Cesare Nori offers you the possibility to pay a 30% deposit to reserve your product. This payment method allows you to spread the payments over a period that suits you. 7.2. Default of payment

CESARE NORI reserves the right to refuse to make a delivery or to honor an order emanating from a consumer who would not have fully or partially paid a previous order or with whom a payment dispute would be in progress of administration.

7.3. Anti-fraud control

The information related to your order is subject to an automated data processing whose responsible is FIA-NET S.A. This automated data processing aims to define a level of analysis of a transaction and to fight against credit card fraud.

FIA-NET S.A. and the merchant where you make your purchase are the recipients of the data related to your order. The non-transmission of data related to your order prevents the realization and analysis of your transaction.

The occurrence of a non-payment due to a fraudulent use of a credit card will result in the registration of the details related to your order associated with this non-payment within a payment incident file implemented by FIA-NET S.A. Our payment system complies with the latest 3D Secure standards set up by Visa (Verified by Visa), by Mastercard (MasterCard SecureCode), and by American Express with SafeKey.

8 • Delivery

8.1. Shipping

From Monday to Friday, all orders placed and validated before 1 pm are shipped on the same day. Orders placed between Friday 1 pm and Sunday will be shipped before 6 pm on Monday.

9 • Returns and refunds

9.1. General return conditions

You need to return the item within 14 days of receiving the package. We accept returns of items that have never been worn, are still tagged, and are undamaged. Items must be in perfect condition and well folded in the packaging to avoid creases. Don't forget to also put the plastic packaging around the parcel to protect it. Personalized products and gift cards cannot be exchanged or refunded, only a credit note can be issued to you.

9.2. Request for exchange against another item or credit note request

In mainland France, for any purchase over 100€, we offer you the cost of your 1st return for any exchange or credit. A Colissimo transport voucher will be sent to you by email. You will need to print it, stick it on your return package and drop it off at a Post Office. For a second return (or more), the return shipping costs are borne by the customer regardless of the order amount. For any order less than 99.99 € in mainland France or outside mainland France, all shipping costs are borne by the customer. Request for credit on our website: the credit request entitles you to a 10% increase of the sum of the returned item. IMPORTANT: any credit obtained in our Cesare Nori store in Toulouse and which would be used on our online store will not result in a refund by our site. A new Cesare Nori credit note will then be generated and can be used in-store or online.

9.3. Request for refund

We offer you the possibility to request a return voucher from our customer service, by email at service.client@cesarenori.fr or directly on your customer account to benefit from our preferential rates. We will send you a voucher by email. You just need to drop off your package at a Post Office located in Metropolitan France. For any order equal to or above 100€, the incurred return shipping costs will be deducted from the refunded amount of the item on the payment method used during your order and will be credited back to you in the form of a credit note in your loyalty pot (worth 10€). For any order less than 99.99€, the incurred shipping costs for the return and the original delivery will be deducted from the refunded amount of the item on the payment method used during your order.

You have the possibility to request your refund within 14 days from the receipt of the package. The refund will be credited to the payment method used during your online order or in the form of an increased credit on your customer account. If your order was shipped to an address within the European Union, all sales taxes are refunded. Outside the European Union, customs and sales taxes are not refundable. You may be able to recover these costs by contacting your customs office directly. 9.4. Conditions of exchange and refund from abroad

Any order made from abroad implies the paid delivery by Colissimo or Chronopost International. You have the possibility to request the exchange or refund of your order within 14 days from the receipt of the package. In the case of an exchange, you must send us back your package by your own means, the return and reshipping costs are therefore at your expense. In the case of a refund, you must send us back the package by your own means. Once the package is received, the refund of your order will be credited to the payment method used during your order or in the form of a credit note on your customer account. The product will be fully refunded, excluding shipping costs. As stated above, sales and customs taxes are not refundable.

10 • Warranties

All products supplied by the seller benefit from the legal warranty provided by articles 1641 and following of the French Civil Code. In case of non-compliance of a sold product, it can be returned to the seller who, after validation of the non-compliance, will take it back, exchange it, or refund it. For any item purchased on our website, we guarantee:

11 • Disputes

The present contract is subject to French law. CESARE NORI cannot be held responsible for damages of any nature, whether material, immaterial, or physical, which could result from a malfunction or misuse of the marketed products. This is also the case for possible modifications to the products resulting from the manufacturers. The responsibility of CESARE NORI will, in any case, be limited to the amount of the order and cannot be implicated for simple errors or omissions that may have subsisted despite all precautions taken in the presentation of the products.

In the event of difficulties in the application of the present contract, the buyer has the possibility, before any legal action, to seek an amicable solution, with the help of a professional association of the branch, a consumer association, or any other counsel of his choice. It is reminded that the search for an amicable solution does not interrupt the "short delay" of the legal guarantee, nor the duration of the contractual guarantee.

It is recalled that in general, and subject to the appreciation of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honors his financial commitments towards the seller. Complaints or disputes will always be received with benevolent attention, good faith always being presumed in the one who takes the time to explain his situations. In the event of a dispute, the customer will first contact the company to obtain an amicable solution. Failing this, the Commercial Court of TOULOUSE (31) is the only competent jurisdiction, regardless of the place of delivery and the mode of payment accepted.

12 • Liability

14 • Archiving - Proof

CESARE NORI will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code. The computerized registers of CESARE NORI will be considered by the parties as proof of communications, orders, payments, and transactions between the parties. Orders are archived for a period of 10 years from the last order.

15 • The gift card

Gift cards available can be ordered within the framework of the distance selling system on the Internet. Any order for a gift card offered on the site implies consultation and express acceptance of these general conditions of sale.

Once ordered, the gift card will only be available by email and must be downloaded, printed, and the fields, name and first name, filled in to be usable.
